Musto T-shirt Competition - Terms and Conditions

Please read these terms and conditions carefully

1. The Musto T-Shirt Competition (the “Competition”) is to contribute to the design of the Ellen MacArthur Cancer Trust’s 2024 T-Shirt.

2. These Terms and Conditions govern the Competition. All other information provided prior to entering the Competition including, without limitation, the route to entry for the Competition and the rules of the Competition, form part of these Terms and Conditions.

YOUR INFORMATION

3. By entering the Competition, you will be providing information to both Musto Limited (“Musto”) and Ellen MacArthur Cancer Trust. Any personal data which we collect from you, or that you provide to us, will be processed by us in accordance with our Privacy Policies set out here:

4. We will use your data to notify you if you win the Competition or if we are otherwise required to contact you in relation to the Competition. Your information will not be shared with any other third parties outside of the Ellen MacArthur Cancer Trust, Musto, and Mallory Group, Musto’s PR Agency. All data, both soft and hard copies will be destroyed after it has served the purpose mentioned in these terms and conditions, unless otherwise required by law or in relation to a claim or dispute.

RESTRICTIONS ON ENTRY

5. The Competition is:

  • open to all UK residents who are classified as “Young People” by the Ellen MacArthur Cancer Trust, and who, at the time of submitting an Entry Form, have or will be supported by the Ellen MacArthur Cancer Trust, in 2023; and
  • not open to individuals classified to anyone connected to the Competition, including the employees and officers (or their immediate families) of Musto and/or the Ellen MacArthur Cancer Trust.

6. We may disregard any entry we believe breaches these Terms.

7. The Competition will run from 0900 GMT Monday 10 July 2023 to 1700 GMT Friday 18 August 2023 (the “Closing Date”). Entries we receive after the Closing Date will not be eligible for entry into the Competition. Proof of postage will not be accepted as proof of entry.

8. Only one entry may be made per person.

9. An entrant must enter their details fully on the registration form. If under 18, permission must be obtained from a parent or guardian before entering the competition. Each entry form must have the signature, name and date of the authorising parent/guardian if under 18.

The young person or, if under 18, the young person’s parent or guardian, accepts all these terms and conditions by entering the competition.

10. By entering the competition, entrants confirm that they have read and agree to be bound by these terms and conditions, and by the decisions of the Ellen MacArthur Cancer Trust and Musto, which are final in all matters relating to the competition. Any breach of these terms and conditions will result in the forfeiture of the prize.

HOW TO ENTER

11. For a chance to win, a completed Entry Form (including parent/guardian authorisation if applicable) must be submitted to us, either by:

  • Post to Musto T-Shirt Competition, Ellen MacArthur Cancer Trust, Units 53-57 East Cowes Marina, Off Britannia Way, East Cowes, Isle of Wight, PO32 6DG
  • Email a clear picture or a scanned copy to [email protected]
  • Handing it to us in person, to a Trust volunteer or member of staff on your trip.

SELECTING THE WINNERS

12. Design winners. Entries will be reviewed by a panel comprising members of the Ellen MacArthur Cancer Trust’s Operations, Communications and Fundraising teams, and one independent person (“Review Panel”). The full names of the judges shall be made available on request. The decision of the Review Panel (acting reasonably) will be final.

13. Entries may be subject to alterations or adjustments by the Ellen MacArthur Cancer Trust or Musto, including, but not limited to, in order to ensure practicality of use.

14. Prize winner. We will attempt to contact a winner (or their parent/guardian) by email, and if no response, contact will be made via phone/post.

15. The winner will be announced in October 2023.

16. We reserve the right to offer the prize to another entrant if:

  • we are unable to contact the winner within 28 days having made reasonable efforts to do so; or
  • a winner does not provide us with any information, consents and/or confirmations we require in respect of the Competition.

17. The winning entry of the competition will receive a prize bundle including*:

  • The 2024 ‘Musto T-Shirt Competition’ winner Long Sleeve T Shirt
  • Musto goody bag to value of £350 RRP

*Suitable sizes for winning person to be provided, subject to availability. If not available a suitable alternative will be found.

18. The winning design will appear on all 2024 Musto t-shirts given to staff, crew and young people on an Ellen MacArthur Cancer Trust trip.

19. The prizes are non-transferable and there is no cash alternative. Musto reserve the right to substitute prizes of equal or greater value at any time in its sole discretion.

20. The Ellen MacArthur Cancer Trust and Musto will provide the winner with details of how their prize can be claimed.

OUR LIABILITY TO YOU

21. As far as permitted by law, the Ellen MacArthur Cancer Trust, Musto and their affiliates shall not be liable for any loss, damage or expense suffered by any entrant or the winners in relation to the Competition or the prizes. The Ellen MacArthur Cancer Trust, Musto and their affiliates will also not be responsible or liable for any further expenses or fees incurred by the winner in collecting, using or enjoying the prize won in this Competition.

22. The Ellen MacArthur Cancer Trust and Musto accept no responsibility or liability for:

  • any entry not received for whatever reason; or
  • if it becomes necessary for us to cancel, terminate, postpone, modify or suspend the Competition and any prizes (or any aspect thereof).

ENTRY STANDARDS AND REQUIREMENTS

23. Competition entries must be original material created by the person whose name is submitted on the Entry Form.

24. Competition entries must not:

  • have been previously published or broadcast, whether in print or online (including self-published as an e-Book, or in a magazine, or on a website);
  • have been submitted to another competition; or
  • have not, do not and will not at any time in the future, infringe any third party’s legal rights, and each Entrant confirms that it will hold us harmless for any losses incurred if the Entrant breaches these warranties.

25. Subject to clause 26 below, you retain any copyright in your entry. You grant us a worldwide, irrevocable, royalty free, perpetual licence to feature all or any part of your entry in our leaflets and marketing materials, on our websites and on social media channels or otherwise as we see fit.

26. If we want to use elements of your submitted Entry Form, you will be required to transfer the copyright or any other intellectual property whatsoever in your entry to us. In particular, you agree to:

  • assign and transfer to us all intellectual property rights in connection with your entry; and
  • us editing the text / image of your entry as we see fit, without your further input or approval.

27. No purchase is necessary to enter the competition and there is no charge for submitting an entry.

28. We are obliged to make available on request, information to indicate that a valid award took place. Each entrant agrees to their first and surname being made publicly available for these purposes. For marketing purposes, each entrant agrees to the use of his/her image in any publicity material and agrees to their first and surname being made publicly available. If you (or if under 18, your parent or guardian) object to such details being published or made available, please contact us at [email protected]. Any personal data relating to any entrants will be used solely in accordance with current UK data protection legislation. Each entrant agrees to their name being shared with Mallory Group, Musto’s PR Agency, for the announcement.

30. Competition entries cannot be returned by the Ellen MacArthur Cancer Trust and Musto. It is suggested that entrants make a copy of their entry before submission.

31. By submitting an entry, an entrant will be deemed to have accepted and be bound by these Terms and Conditions.

LEGAL BITS

32. Our Details:

  • Musto Limited - incorporated and registered in England and Wales with company number 01004420 whose registered office is at International House St Katharine Docks, St. Katharines Way, London, England, E1W 1UN (Musto).
  • Ellen MacArthur Cancer Trust – a charity incorporated with charity number 1096491, registered company number 04597114, registered OSCR number SCO44013 and registered office at Units 53-57 East Cowes Marina, Off Britannia Way, East Cowes, Isle of Wight, PO32 6DG.

33. Events beyond our control: Events may occur that render the Competition itself or the selection of the winners impractical due to reasons beyond our control. We may make such variations to the Competition as we feel are necessary as a result of such events.

34. Cancellation of the Competition: We reserve the right to cancel, terminate, modify or suspend the Competition in whole or in part.

35. Entire Agreement: These Terms constitute the entire agreement between us in relation to the Competition.

36. Variation: We may update these Terms and the Privacy Policies set out above from time to time without prior notice. We will attempt to notify you of variations by placing a suitable notice on the website(s) or social media channel(s) where we promote the Competition.

37. Assignment: We may assign or deal in any other manner with any or all of our rights and obligations under or arising from these Terms.

38. 3rd Party Rights: These Terms relate to an agreement between you and us. No other person shall have any rights to enforce any of these Terms.

39. Applicable Law: The Competition shall be governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any associated dispute or claim, except that if you live in Scotland or Ireland, you can bring legal proceedings in the Scottish or Irish courts.

40. “Us” and “We” refers to both Musto Limited and Ellen MacArthur Cancer.

41. “You” refers to the person taking part in the competition.
